At the end of May the European Commission published its long awaited Evaluation Report on Block Exemption.

The report concludes that Block Exemption regulation should NOT be replaced in 2010, but instead the industry should rely on a basket of existing 'general' competition legislation and some new industry specific legislation 'Euro 5' which comes into force for all new models of vehicle launched in 2009 and onwards.

In 2002 it was felt necessary to have an industry specific Block Exemption Regulation which set ou tto protext the independent aftermarket, the vehicle manufacturers main dealers and the consumer from the vehicle manufacturers using technology to create monopolies for the repair and service of their brand vehicles. Since 2002 there has been a huge increase in the technology so the need is greater now than ever before!

Japanese Import Cars

Vehicles made by Japanese manufacturers for the Japanese domestic market that are imported for the UK used car market are sometimes referred to as 'Grey Imports'.

 

Japanese vehicle owners typically own their cars for three years before buying a new model. There is an excess of 'second hand' cars in the Japanese market with negligable demand in their homeland. In comparison to other used cars in the UK the japanese imports usually have a lower than 'average' millage, and a higher standard specification over equivalent UK specification models intended by the manufacturers to be sold to the UK market via franchised dealers.

Right to Repair Campaign

The Right to Repair Campaign (R2RC) is the response of the entire repair sector for motor vehicles to defend the rights given to Block Exemption Regulation (BER). The Block Exemption includes elements that give the consumer the freedom to choose where they have their vehicle maintained without negating manufacturers' warranties. To enable repairs to be made, the vehicle manufacturer under BER should make technical information freely available.
